If the gusset does not lay flat and you have overage on the sides the cup is definitely too small which means you are a 38HH (D8) or J (D10) depending on how much spillage you had in the 38H (D9). There are very limited styles in your size that are offered in smooth cups. The elomi Hermione bra 8120 is available in a 38HH (D8) cup which might be an option for you.
